McCain prefaced his response by saying that the questioner 'probably hadn't heard of Fannie Mae or Freddie Mac'. This, in turn, caused anti-McCain folks to accuse him of being condescending. The fact is that the whole sub-prime mess was caused by 'people were supposed to know' failing to act. So, at this point, it's not a stretch to assume people who 'weren't supposed to know things' didn't know them, and maybe still don't. Whenever I give this talk the room is always packed with people who want to know the step-by-step process of becoming more digital. About six months ago Dane Ciolino and I were tapped to give this presentation together, which was great because, over the years, Dane and I have often had lunch together to talk about our 'paperless law practices' and share ideas on how to make things better. So presenting together was a lot of fun for us, and (from the feedback we got) entertaining and informative for the audience. This summer Dane and I taught a 'virtual class' together at Loyola Law School. The class was about practical lawyering in the digital age, and it was done purely over the Internet. When the class was announced there was a rush to sign up, but we limited the class to 20 students so that we could ensure quality and work out any kinks without too much chaos. Everything went pretty smoothly and, once again, the class was very well received. It occurred to us that there's a big demand for this kind of information, and it's not really being presented very often around Louisiana. So, we decided to take the bull by the horns and put on our own CLE Seminar. The idea is to create a group of basic, intermediate, and advanced sessions. And to present them on a fairly regular basis. We're going to start with a 3 hour session on December 12th, in the morning. For more information, and to register for the seminar, click here. I've often recommended that people attend his seminars. Invariably, those to whom I made this recommendation returned to thank me profusely. Surprisingly, I had never attended any of his seminars. Today, Mr. Garner was the opening speaker at the ABA Forum on Franchising in Austin, Texas. To say I had great expectations for the speech would be an understatement. Amazingly, he far exceeded my high expectations. He is not only a great instructor of writing, but also an amazing speaker—perhaps one of the top two or three speakers I've ever seen. If you think you know a lot about legal writing, and you attend his seminar, you will find out that you don't know quite as much as you thought. You'll emerge from the speech, however, with concrete knowledge of how to improve. In fact, simply by attending the seminar you will have improved your writing—even if you don't follow his simple prescriptions for improvement. He offered four tasks that would lead to better writing in six months. I was glad to know I'd inadvertently fulfilled the first task: subscribing to The Economist and The New Yorker. If you ever get a chance to see him speak do whatever you can to make it happen. You won't regret it. I promise! 04:51 PM in Legal Writing | Permalink | Comments (0) October 11, 2008 How to improve your portraits I am rediscovering photography, as I may have mentioned recently. I got my first 35mm camera when I was about 15 years old and it's always been one of my abiding interests. For many years, I wasn't particularly good at taking pictures. But if you do something enough, over time you can't help improving bit by bit. Photography taught me a lot about technology; cameras are complex machines and part of the process is learning to use them without having to think too much. In other words, the tech part has to become natural. For most people (me included) this has always been hard. For something to be 'natural' it has to be simple. The new digital cameras can do so much more than the old mechanical cameras. And the software that can be used to manipulate images (i.e. Photoshop or Photoshop Elements) is powerful, but infinitely complex. That's why most people don't even bother to manipulate their photos very much. I wouldn't either, except that I discovered books by Scott Kelby, who is a great photographer and an expert in Photoshop. More importantly, he's a great teacher. For example if you have the $79 Photoshop Elements program (Mac or PC) and you buy Kelby's $29 book you can learn to transform ordinary portrait shots into amazing shots. Here is a before and after of one I did on a quick snapshot of my brother Stu. You don't have to know anything about Photoshop Elements (I didn't) or about retouching photos. All you have to do is have the book and follow the instructions for improving portraits (or landscapes or black & white pictures etc.). If you have a digital camera and want to improve your pictures this is the best way to do it. The first time you do it it will take 20 minutes. Eventually you'll be able to retouch a photo like this in about 5 minutes. If you want to know who a political candidate really is then you need to dig a little deeper than the traditional fare served up by the most mainstream of The Mainstream Media. As a lawyer, I know not to believe everything I hear or read. But I also know that if you want to find out what's really going on you have to read a lot and then judiciously parse what you read. This article on John McCain is no doubt written by someone who doesn't like McCain, but it cites a number of incidents with specific names. If you wanted to know the real John McCain you'd check out all of these incidents and see which ones are true but not widely discussed by the mainstream media. There is a long and disturbing list of improprieties here, and some of them have been reported and are undeniably true. Some of them are vaguely sourced. It is undeniably true that McCain is a hothead, to the point that some respected GOP colleagues have questioned whether he's too dangerous to be President. If I was undecided I'd take some time to probe these reports and see if they are true. If you really want to know what's going on you're going to have to do more than just watch debates. And, frankly, the same is true for Obama. He has less of a record to work with, but from what I can tell the worst stuff has come out. Is he too liberal? I don't know. But I don't think that there is any indication that he has a personality disorder. The pundits are boiling over with all manner of speculation, such as: Will Joe Biden come across as too overbearing? Will Sarah Palin commit any gaffes? Will the looming financial collapse play a factor in the debate? My big question is this: will Sarah Palin be doing live updates to her Twitter page during the actual debate? Email | Print | Share | Reprints | Single Page [-] Text [+] By Patrick Rucker ARLINGTON, Virginia (Reuters) - Federal Reserve Chairman Ben Bernanke said on Tuesday the U.S. central bank may keep an emergency lending facility for big Wall Street firms open longer than it initially intended, a signal the Fed is fearful of shutting down a vital backstop. Credit costs have been driven higher and U.S. economic growth also has been hurt by market turmoil, Bernanke said at a forum sponsored by the Federal Deposit Insurance Corp. "We are currently monitoring developments in financial markets closely and considering several options, including extending the duration of our facilities for primary dealers beyond year-end, should the current unusual and exigent circumstances continue to prevail in dealer funding markets," Bernanke said. Remarks by Bernanke and Treasury Secretary Henry Paulson, who spoke at the same conference, calmed financial markets, which had been rattled this week by the possibility that government-sponsored mortgage finance providers Fannie Mae and Freddie Mac would be forced to raise substantial new capital. Wall Street stocks soared, prices of short-term U.S. Treasury debt securities eased and the dollar posted gains. "The last thing he wants to do is walk away and see a dealer collapse," Anton Schutz, portfolio manager at Mendon Capital Advisors in Rochester, New York, said of Bernanke. "It's all about safety and soundness," he added. Paulson contributed to market optimism by saying that flatter sales of existing homes in recent months implied some stabilizing in home-buying demand. STILL UNDER STRAIN The Fed set up the so-called Primary Dealer Credit Facility, or PDCF, in March as part of its effort to facilitate the purchase of ailing investment bank Bear Stearns by JPMorgan Chase & Co. It said at the time the PDCF would continue for at least six months. The lending program allows primary dealers -- the biggest firms that deal directly with the Fed -- to borrow directly from the Fed at the discount rate, currently 2.25 percent. The Fed's action came after weeks of turbulence in financial markets had raised fears a credit crisis stemming from rising mortgage defaults was spiraling out of control. Borrowing at the primary dealer facility averaged as high as $38 billion a day in March and early April, but eased to $1.7 billion a day in the week ended July 2. Bernanke said, though, that markets were still strained. One indicator of banks' willingness to lend to one another, the gap between the three-month London interbank offered rate, or Libor, and three-month overnight index swaps, was at its widest in over two months on Tuesday. Bernanke said the Fed, working with other regulators at home and abroad, "has redoubled its efforts to strengthen the capital positions, liquidity reserves, and risk-management practices" of financial institutions it supervises.? They buy large pools of mortgage loans made by banks and other lenders, attach a guarantee that the loans will be repaid and then sell securities backed by the future payments on those mortgages."The housing market can not recover unless Fannie and Freddie are out there actively securitizing home mortgages," said Jaret Seiberg, financial services analyst for research firm Stanford Group. Shares of the two companies plunged Monday after a note from Lehman Brothers suggested that Fannie and Freddie might be forced to raise a combined $75 billion due to a pending change in accounting rules.Spokespeople from Fannie (FNM, Fortune 500) and Freddie (FRE, Fortune 500) had no comment about their stock prices or the Lehman report.Seiberg said the two companies don't need new capital right now to keep buying mortgages. But with both companies expected to report losses this year, they may need more capital down the road."They anticipate suffering more losses in the future and capital is one of your cushions against those losses," Seiberg said.But with shares of Fannie and Freddie each plunging about 60% so far this year, finding investors willing to invest additional capital in the firms will be both problematic and expensive.If Fannie and Freddie were suddenly unable to buy and back loans, banks would have their primary source of funding for making home loans choked off. That would severely restrict the pool of potential home buyers, causing home price declines to accelerate from the record drop seen in the last year. That would make it tougher for the economy to rebound anytime soon.Risk of a credit market meltdownAlthough Lehman Brothers analyst Bruce Harting downplayed the likelihood that Fannie and Freddie would be forced to raise more capital, the note did spell out the dire implication for housing and the economy should either firm face failure due to rising losses from the more than $4 trillion in mortgages the two firms back."We believe any threat of [a Fannie or Freddie] failure could trigger a meltdown in credit markets that would make the movements in credit markets that we've seen over the last year look like a modest hiccup," Harting wrote. "Needless to say, the impact of a dislocation of that order could cause serious harm to the global economy."With their government charter and their importance to the economy, analysts are convinced the federal government would move rapidly to bailout Fannie and Freddie should they be faced with a failure. And most analysts believe that this implicit guarantee should stop Fannie and Freddie from facing the kind of crisis of confidence that brought on the rapid demise of Bear Stearns in March. Jay Brinkman, vice president of research and economics for the Mortgage Bankers Association, says that he believes Fannie and Freddie have adequate capital today, but that it is essential that they be able to continue to raise additional capital going forward."Fannie and Freddie do play a crucial role in the markets," he said. "They're much much larger than anything we saw in the subprime market."James Lockhart, director of the Office of Federal Housing Enterprise, which regulates the two firms, said in an interview with CNBC Tuesday that he believes the firms have done a good job raising adequate capital. He said it is important that his agency be given broader oversight over their operation going forward. That need for regulatory reform was echoed Tuesday by Federal Reserve Chairman Ben Bernanke."If these firms are strong, well-regulated, well-capitalized, and focused on their mission, they will be better able to serve their function of increasing access to mortgage credit, without posing undue risks to the financial system or the taxpayer," said Bernanke in a speech to bankers..More trouble on the horizonBut others see further risks ahead. The Wall Street Journal's influential "Heard on the Street" column Tuesday wondered whether shares in Fannie and Freddie will have any value left once the housing crisis is done. The column also raised the specter of a government takeover of their operations.And with trends showing rising defaults in the prime mortgage loans that are the firms' bread and butter, some argue that the worst is yet to come. One area of major concern has been the mortgage industry - from participants in the subprime market to how regulators are dealing with things now. While there is lots of media attention and discussion in Congress, there aren't many resources that convey what is actually happening. The Mortgage-Backed Securities volume of the Securities Practice Series was recently updated to include much discussion of the subprime mortgage crisis. For example, to learn about Fannie Mae's role in subprime mortgages, do a search of "fannie mae" /p sub-prime in the MORTSEC database. For a more novel approach to the problem, the City of Cleveland recently sued some of the nation's largest lenders, alleging they created a public nuisance by selling high volumes of subprime loans, leading to mass foreclosures. The demonstration is at the NXTcomm conference and trade show in Las Vegas and involved a return loop of 100GbE traffic to Las Angeles. Infinera, Avago and Ixia are the equipment suppliers for the 100GbE feat, which traveled over the XO network. The 100GbE link is not compliant with the IEEE (define) standard because it doesn't yet exist (though there are a pair of approved baseline standards that have been approved, which is what the Los Angeles to Las Vegas link are leveraging). But the test, and the effort to move to 100GbE is of paramount significance to the Internet because the throughput speeds will expand the available bandwidth for data transport to help meet the growth in demand. "When standards are fully ratified in a few years we expect that fully standard implementations will be following very quickly." Perkins said service provider networks have been using 10GbE today and then using some form of link aggregation like the IEEE 802.1ad standard to bond the links together. Perkins noted that currently service providers can bond 16 10GbE links together, providing an aggregate of over a hundred gigabits of bandwidth. "Link bonding approaches today while getting the job done - are strained," Perkins explained. "And in terms of operational management issues there are overhead cost issues. Traditionally, Salesforce (NYSE: CRM) upgrades its software around three times per year. With the upgrade, all 43,000 Salesforce customers have immediate access to the new platform, since its main bragging point is that no software needs to be rolled out to client computers. Force.com, the Platform-as-a-Service (PaaS) that allows developers to build their own applications to run along side the ones provided by Salesforce, has been expanded out to allow for developing any kind of application the users want with Apex, Salesforce's Java-like programming language. Also, Visualforce is now live in every edition of Salesforce, enabling developers to create their own custom interfaces based on Web 2.0 UI items that will work on any device. So it's possible to make your Force.com applications run on a PC, laptop, BlackBerry or iPhone. "Any client with a browser is covered. There's definitely a need for different UIs, even if they use the same app." As such, Visualforce lets developers create an application that presents data one way on a desktop, and in a different way on a notebook or smartphone. One of the knocks on Web 2.0 is the performance of Ajax, which requires a lot of JavaScript to run on the client.
